Exercising Your Personal Data Rights

California Consumers have the following rights under the CPRA:

  • The rights to access, correct, or delete Personal Data;
  • The right to obtain a portable copy of Personal Data;
  • The right to limit the use of Sensitive Personal Data in certain circumstances; and
  • The rights to opt out of the sharing of Personal Data for behavioral advertising, sales of personal data, or certain profiling.

If you are a California Consumer, you can submit a request to exercise your personal data rights under the CPRA by:

3) Visiting a Big 5 retail location during regular business hours

To protect your privacy, we may need to authenticate your identity before we respond to your rights request. We will use commercially reasonable efforts to verify your identity for this purpose. Any information you provide to authenticate your identity will only be used to process your rights request. Please be aware that we do not accept or process rights requests through other means (e.g., via fax, email, or social media).

After submitting your request online, you will receive a follow-up email, which may include a link you must click on in order to verify your identity. If you do not click on that link, we may be unable to complete your request due to lack of verification. It is important that you provide a valid email address in order for us to be able to process your request.

We will respond to your rights request within 45 days, though in certain cases we may inform you that we will need up to another 45 days to act on your request. If we suspect fraudulent or malicious activity on or from your account, we will delay taking action on your request until we can appropriately verify your identity and the request as authentic. Also note that each of the rights are subject to certain exceptions.

We reserve the right to decline to process, or charge a reasonable fee for, requests from a Consumer that are manifestly unfounded, excessive, or repetitive.

Behavioral Advertising

The CPRA defines “sharing” as disclosing Personal Data to a third party for behavioral advertising, sometimes referred to as “targeted advertising.” An example of this is displaying advertisements to a consumer where the advertisement is selected based on Personal Data obtained from that consumer's activities over time and across nonaffiliated websites or online applications to predict such consumer's preferences or interests. We share some Personal Data for behavioral advertising. You can opt out of the sharing of your Personal Data for behavioral advertising by submitting a rights request as described above and by going to the following link and modifying your preferences:

Limiting the Use of Sensitive Personal Data

The CPRA provides a right to limit some uses of Sensitive Personal Data except as necessary to provide goods or services you have requested. In particular, you may direct companies not to use Sensitive Employee Personal Data except as necessary to provide goods or services you have requested.

Children

Our services are not directed to children, and we do not knowingly collect Personal Data from children under the age of 16. If you learn that a child has provided us with Personal Data, then you may contact us as indicated below.

Non-Discrimination

To the extent prohibited by applicable law, we will not discriminate against you for exercising any of your CPRA rights. For example, unless permitted by the CPRA, we will not do the following in response to your exercise of any rights under the CPRA:

  • Deny you goods or services;
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties; or
  • Provide you a different level or quality of goods or services.

Big 5’s E-TEAM (Notice of Financial Incentive)

Our E-Team is free to all customers and rewards you for providing us with your name, contact information, and other Personal Data that you may choose to provide us from time to time. You may opt-in either in-store or online on our website at big5.com, including web address: big5.com/eteam. We collect and keep the Personal Data provided when you join our E-Team. Additionally, in an effort to enhance your experience with Big 5, we collect Personal Data provided through or in connection with your interaction with E-Team promotions and your Big 5 purchase history. Members of the E-Team receive an initial new member coupon and, thereafter, regular coupons and other promotional offerings, which may be used to purchase products from Big 5, subject to the terms and conditions of the offering.

You may withdraw your membership at any time by following the unsubscribe option in an E-Team email or by contacting our customer service team toll free at (800) 898-2994 or feedback@big5corp.com.

Big 5 values the data of E-Team members because it allows us to engage with and reward our most loyal customers with coupons and other promotions tailored to their purchase history and interests. The value of each consumer’s data as an E-Team member depends in large part on the consumer’s level of engagement and purchase activity with us as an E-Team member compared to the same had such consumer not joined the E-Team.

If you are a Big 5 E-Team member and request deletion of part or all of your Personal Data, that could affect your E-Team membership. If we cannot retain your Personal Data, you will no longer be an E-Team member, and would forfeit any future E-Team benefits.

Authorized Agent Requests

The CPRA allows you to designate an authorized agent to make a rights request on your behalf. Your authorized agent may submit such a request by following the same method described above. We may require verification of your authorized agent in addition to the information for verification above for Consumers and households.

Policy Access

Our goal is to permit our consumers to access this policy and the features available under this policy, whether or not they are using assistive technologies, like a screen reader, magnifier, or other technology. We will work with you through a communication method that is accessible for you, consistent with applicable law, to provide you with access to this policy.

Changes to This Privacy Notice

We reserve the right to amend this California Privacy Notice at our discretion and at any time. If we make any material changes to this California Privacy Notice, we’ll notify you of such changes by posting them on the Services or by sending you an email or other notification.

California Do Not Track Disclosures

Under California’s "Shine the Light" law, California residents who provide personal information in obtaining products or services for personal, family, or household use are entitled to request and obtain from us (once a calendar year) certain information about the customer information we shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year (e.g., requests made in 2014 will receive information regarding 2013 sharing activities).

To obtain this information on behalf of Big 5 Corp. please send an email message to Customer Service at feedback@big5corp.com with "Request for California Privacy Information" on the subject line and in the body of your message. We will provide the requested information to you at your e-mail address in response. Please be aware that not all information sharing is covered by the "Shine the Light" requirements and only information on covered sharing will be included in our response.

Notice to Nevada Consumers

Nevada law gives Nevada consumers the right to request that a company not sell their personal information. This right applies even if their personal information is not currently being sold. We do not sell the personal information of any consumers.
